Priya Kapur, trustee and beneficiary of the RK Family Trust, has issued a notice removing Rani Kapur as a trustee, citing breach of fiduciary duties and conduct adverse to the interests of the trust and its beneficiaries.
The trust was created in 2017 by Rani Kapur for the benefit of her son, the late Sunjay Kapur, who was its sole beneficiary during his lifetime. Following his death on June 12, 2025, the beneficial interests devolved upon his legal heirs in accordance with the trust deed.
Legal dispute before Delhi High Court
On January 10, 2026, Priya Kapur issued a cease-and-desist notice alleging that statements disputing the validity of the trust and claims of personal ownership over its assets were prejudicial to beneficiaries.
On January 20, 2026, Rani Kapur filed a civil suit before the Delhi High Court seeking a declaration that the trust is invalid and claiming ownership of the assets.
On March 21, 2026, Rani Kapur issued a notice seeking to remove Priya Kapur as trustee under Clause 8.12 of the trust deed.
In a subsequent notice dated March 24, 2026, Priya Kapur stated that challenging the trust while exercising powers under it constitutes a breach of fiduciary obligations. The notice said Rani Kapur stands removed as trustee with effect from March 25, 2026, and no longer has authority to act on behalf of the trust.
The matter relating to the validity and administration of the RK Family Trust is currently pending before the Delhi High Court.
“Trust law does not permit a trustee to simultaneously challenge the existence of a trust while exercising powers under it.”
